What is Bankruptcy?

WHAT IS BANKRUPTCY
Bankruptcy if a federal code which will allow you to discharge all of your unsecured debts.  Discharge means that your debts will be wiped out, you will get a clean financial slate.  This is for real.  Bankruptcy really does exist and it is not the end of your financial world.  It is not like the board game where you lose everything you own.  Bankruptcy is actually designed to help you get a fresh financial start and usually all of your assets are protected under the exemptions provided under the bankruptcy code.
BANKRUPTCY CHAPTERS
There are two basic chapters of bankruptcy available to the general consumer.  The most common and most sought after is a Chapter 7.  Under a Chapter 7 Bankruptcy you would be able to discharge all of your unsecured debts.  These debts include credit card debts, medical debts, utilities you may be behind on.  In the State of Ohio you can even file on your drivers reinstatement fees (once in your lifetime).  So there are many benefits to filing for Chapter 7.
In Chapter 7 if you want to keep your home or vehicle this is possible.  You must be current on your payments to keep these secured debts.  It will be up to the creditor to send documentation for you to re-sign your debt called a reaffirmation agreement.  Once you sign this reaffirmation agreement and it is filed with the court, this debt would not be discharged through your case and as you continue to make your payments on these debts they will be reported to the credit reporting bureaus, therefore, rebuilding your credit.
Chapter 7 can stay on your credit report for up to 10 years.  But the important thing to remember after bankruptcy is to make all payments that you reaffirmed on time and not let anything go into collections.  You will be surprised at how fast your credit rating will improve just by following these steps.

Chapter 13 Bankruptcy is a repayment plan.  Chapter 13 is designed to help you save your home from foreclosure or your vehicle from repossession.  If you are behind on your home or vehicle, Chapter 13 can save them.  Under the bankruptcy code for Chapter 13, all collection efforts must stop.  You would then make your current and the payments you were behind on through your case.  You will have a three to five year period to complete this Chapter 13.
Under Chapter 13 you will pay back a small percentage to your unsecured creditors.  This percentage will vary based on your individual case.  When you complete your case and receive your discharge any remaining balance owed to your unsecured creditors will be discharged just like in a Chapter 7.

Bankruptcy Before or After Divorce?

Are you considering divorce from your spouse?  There are a lot of factors to consider when deciding to divorce.  Most of the time there is a lot of combined debt that the two of you have accumulated together.  What should you do about this debt?  Split it up and hope that you can make the payments going forward?  This will most likely not be the case.  In most instances you will end up not being able to afford the debts you created during your marriage on your own.  Many people get their divorce and later down the road both parties will end up having to file for bankruptcy protection under separate cases.  This would mean you would each have to pay your own filing and attorney fees.
If you are getting a divorce or a dissolution it is most likely in your best interest to go ahead and file for bankruptcy together, this way you can both get a real fresh start with your lives.  Even if you have already separated and are no longer living together it is still possible for you to file a bankruptcy together.  If you file together this would mean that you would only have to pay one filing fee and your attorney fees would be combined.  This would be in your best financial interest.
If you cannot stand to be in the same room with the person, that can be arranged.  We can do the whole bankruptcy process separate.  The only time you would have to see each other would be at the actual court date.  This would be no more than 15 minutes together.  It would be well worth it when you consider the cost of filing separate cases.

Life After Bankruptcy

Many people find themselves feeling unworthy, depressed or frightened when considering going through a bankruptcy.  People who experience this process are always worrying about how to take care of their debts.  Bankruptcy should be looked at as a way to move forward, and get things back on the right financial track.  There are many reasons that people get off the right financial track, job loss, divorce and medical expenses are just a few.  You should not feel unworthy, depressed or frightened at this experience, bankruptcy does not mean that you are a bad person, just that you are a good person in a bad financial situation.  In bankruptcy you can discharge all of your unsecured debts and get the fresh financial start you are looking for.

HOW TO REBUILD CREDIT AFTER BANKRUPTCY
The main objective to rebuilding your credit after bankruptcy is to pay all debts that you have reaffirmed on time.  Also any new debt that you incur you should also pay this on time and not allow any debt to go into collection.  Follow these rules and before you know it you will be able to obtain more credit.
Of course you do want to wait a while before you go out and try to get new credit which turns into debt.  Why would you want to create debt anyway when you just went through a process of getting rid of debt and you cannot do it again for another 8 years.  It is best to live on the cash that you make and not credit.  There is nothing wrong with living on what you make, that is called living within your means.  When you start buying things on credit you are basically living above your means.  If you can't pay for it with cash, do you really need it?  These are the important questions you have to ask yourself.
