Bankruptcy & Debts

Are you struggling with debt?  Thinking of filing for bankruptcy, but not sure how to gather all of your debt?  It's not unusual for some debtors to ignore bills and phone calls from creditors, and some borrowers do not even know how much they owe or who them owe.  But what do you do when are are ready to tackle the problem?  How do you identify all of your consumer debts?
STEPS TO IDENTIFY CONSUMER DEBTS
First, to identify your consumer debts you will need to gather all of your bills together.  It is not a good idea to just throw away your bills that come in the mail even if you know you cannot pay them.  It is best just to start a pile of bills and keep all that come in the mail. that way you can be sure that you have all of the bills that you owe.
Next it is important to pull your credit reports.  You can pull your free credit report once a year.  There is a real and true website which provides this information www.annualcreditreport.com.  They will mail your credit reports to you in the mail.
If your consumer debts have been sold to a collection agency they will most likely be reported to the credit reporting agencies and will be listed on your credit reports.  This is also why it is a good idea to keep all documentation that comes in the mail so that you may notify all of your creditors when you file your case.
DON'T THESE DEBTS GO AWAY AFTER A PERIOD OF TIME
Many people believe that if they just wait long enough their debt will go away by virtue of the statute of limitations.  However, in the State of Ohio, each time a debt is sold the statute of limitation will begin again. Therefore, it is most likely that the debt will never just go away on its own.
BANKRUPTCY CAN HELP YOU
Bankruptcy is available for consumers who are struggling with debt.  in a Chapter 7 you can wipe out all of your unsecured debt and get a fresh financial start.  You do want to make sure you list all of the creditors so that you can really start fresh without any lingering debt that you forgot.  At our office we offer you a free consultation  At this consultation you will be able to sit down with one of our attorneys and discuss your individual situation.  The attorney will quote you a fee based on your case.  If you decide to move forward a small retainer fee will get retain our office.  Once you retain our office you will be able to stop paying on debts that you do not want to keep.  And you will be able to refer those creditors who are harassing you to our office and we deal with them until your case is filed.  We will then take payments until you are paid in full and then your case will be filed.
The court will notify all of your creditors listed on your case of your bankruptcy filing.  They will then no longer be able to contact you in any way, including by phone or in the mail.

Bankruptcy & Utility Shut Offs

We are bankruptcy attorneys we have offices located in Eastgate, Ohio, Middletown, Ohio and Dayton/Centerville, Ohio.  We specialize in Chapter 7 and Chapter 13 bankruptcy filings.
As of today spring is only 31 days away!  We are all looking forward to spring.  It has been a long winter.  In the end it is also turning into a very cold and snowy winter.  Keeping your home warm is a priority.  No one wants to be cold, especially in your home.  But with these temperatures it is even difficult to keep your home warm, people bundle up on the couch under blankets to keep warm, wear layers of clothes and hope they don't have to go outside. With these temperatures, you do not even need to crank up the heat to make your furnace work overtime.  Just keeping your home barely comfortable can result in high utility bills.  But it is cold outside and we need to keep warm and in these days the utility company is our main supplier of our warmth, so we keep the thermostat down as far as we can, bundle up and dread the utility bills.  During the cold winter months utilities bills can get out of control.
The utility companies do not really care that it is wintertime, and your bill is outrageous, their main concern is their bottom line - collecting funds and turning a profit for the services they provide.  So for many, their utility costs will skyrocket and before they know it they will have a disconnection notice from the utility company.  This is the last thing that you want is your utility off during the cold months. Sometimes they will work with you and make a payment arrangement, this is good.  But for many the arrangement they want to set up is not feasible due to the high running balance on their bill. Bankruptcy may be a option for people facing this dilemma.
WILL BANKRUPTCY STOP MY UTILITY SHUT OFF?
Yes, you can file for bankruptcy protection on your utility bills, such as your electric bill.  If you file for bankruptcy you will be under the protection of the bankruptcy stay and the utility company will not be able to shut off your utility.  They will start your bill off fresh from your filing date going forward.
WHAT OTHER TYPES OF DEBTS MAY BE INCLUDED?
You can file for bankruptcy protection under most debts.  The real question here is what types of debts may not be discharged under the bankruptcy code.  Non-dischargeable debts include debts such as spousal or child support, student loans, criminal fines and most taxes.  Most other types of debts that you can think of can be discharged through a bankruptcy case.  Credit card debt, medical debt, deficiency balances on items that have been returned to creditors, all of these may be discharged through a bankruptcy.
THIS SOUNDS GREAT, WHAT'S THE FIRST STEP?
The first step to deciding if bankruptcy is the right decision for you is setting up your free consultation at our office.  At this free consultation you will be able to sit down with one of our experienced attorneys and discuss your individual situation.  They will advise you of the best path for you to take.  If bankruptcy is the resolution to your current situation.  If you do decide to move forward a small retainer will get things started and we will then accept monthly payments on your account, during the time you are making payments you can refer your creditors to our office.  This will ease your mind.  Of course if you have a utility shut off you would want to hurry up this process so that we can go ahead and get your case filed.  We will guide you as to the documents you will need to gather to file your case.

Bankruptcy

We are a bankruptcy firm we have offices located in Eastgate, Ohio, Middletown, Ohio and now Dayton/Centerville, Ohio.  We specialize in Chapter 7 and Chapter 13 bankruptcy filings.
Bankruptcy is a process in which consumers and businesses can eliminate or re-pay some or all of their debts under the federal protection of the bankruptcy stay. Basically there are two types of bankruptcy available for the consumer; Chapter 7 and Chapter 13.
CHAPTER 7
Chapter 7 bankruptcy is designed to clear off or discharge all of your unsecured debt. This will give you a fresh financial start. Creditors can no longer collect on debts by telephone calls or court proceedings. If there were secured items that you wish to keep such as your home or vehicle you would re-sign on these items under a reaffirmation agreement.
reaffirmation agreement is a document that you would sign to reaffirm debts that you do not want to discharge through your bankruptcy. The debts that are re-signed on will report to the credit reporting agencies and help to re-build your credit.
Chapter 7 is also referred to as a "liquidation bankruptcy" because the trustee may take and sell or liquidate some of your property to pay back some of your debt. However, you will be able to keep most if not all of your property due to the protection of the exemptions. These include such things as your home, vehicle, cash on hand, jewelry, household items, retirement plans, and most other assets. The exemptions vary so you should contact our Eastgate, Ohio bankruptcy firm for further details.
Are you eligible for a Chapter 7 Bankruptcy. Not everyone can qualify for Chapter 7, there are several factors to consider, but most can qualify. Contact our office today for your free consultation to see if you qualify for Chapter 7 Bankruptcy.
CHAPTER 13
Chapter 13 is also referred to as a "wage earner" plan because in order to file for Chapter 13 protection you must have a reliable source of income so that you can repay all or a portion of your debt,
In Chapter 13 bankruptcy you will pay back a percentage of your unsecured debts, this can range from 1% to 100% depending on your individual situation. Chapter 13 can also stop a foreclosure action and a vehicle repossession and allow you to make up your missed payments through the chapter 13 plan.
If you file for Chapter 13 be prepared to be in the case for a minimum of 3 years and a maximum of 5 years. It will be up to the creditors to file a claim in order to be paid during this case. During this time period you will repay a percentage of your unsecured debts, your secured debts and any missed payments you had on your house or vehicle. At the end you will receive a discharge as to all remaining debt.

Choosing a Bankruptcy Attorney

We are bankruptcy attorneys we have offices located in Eastgate, Ohio, Middletown, Ohio and Dayton/Centerville, Ohio.  We specialize in Chapter 7 and Chapter 13 bankruptcy filings.
ARE YOU THINKING OF FILING FOR BANKRUPTCY
Are you thinking of filing for bankruptcy.  Looking for an attorney to represent you through the process?  Calling around to get a fee?  Looking for the lowest fee around?  Just remember that you get what you pay for.  Bankruptcy is a very specific process and must be done correctly so that your case will go through and you will receive your discharge through your case.  You do not want any snags and want everything to go through smoothly.  It is stressful enough when everything goes just right let alone when things are messed up.  Some believe that bankruptcy is simple, so simple that they can even take care of it themselves.  This may have been the case in the past but since the Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA) of 2005 things are much more difficult and more precise.  It is not recommended that you attack this task on your own.
Trying to file for yourself will most likely cause you more headaches than you would like to endure.  So the decision to seek an attorney to help you through the process is the best one.  You will want to find an experienced attorney who specialized in bankruptcy.
OUR LAW OFFICE
At the Law Office of Keegan and Andrade we specialize in bankruptcy, this is our main focus of practice.  Our office has specialized in bankruptcy for over 25 years.  We can provide you with the expertise that will make your bankruptcy seem simple and before you know you will be on with your debt free life.
FREE CONSULTATION
At our office we will offer you a free consultation where you will be able to sit down and discuss your individual situation.  They will be able to advise you as to the best road for you to take on your financial journey.  Sometimes bankruptcy is the answer, sometimes it may not be the best decision.  The attorney will advise what is best for you.
At this free consultation the attorney will quote you a fee.  If you decide you want to move forward a small retainer will retain this office.  Once you have retained our office you will quit paying on bills you do not want to keep and refer your creditors to our office until your case is filed.  We will accept monthly payments until your case is filed.
